• The GTC regulates the contractual relationship between PAINT TECH GROUP SRL (hereinafter referred to as the “Seller”) and the buyer (hereinafter referred to as the “Buyer”).
• By placing an order via the online ordering interface, the Buyer accepts the GTC.
• The GTC obliges the Buyer to place an order and make payment as intended.
• The Buyer places an order for the products on the online ordering interface.
• The order is confirmed by e-mail, which means the conclusion of the contract.
• The Seller reserves the right to reject the order without giving reasons.
• The prices displayed are net prices, excluding VAT (EUR, RON).
• Payment: advance payment or cash on delivery, unless otherwise agreed in writing by the parties.
• In case of late payment, the Seller is entitled to charge interest on late payment in accordance with Romanian law.
• The Seller delivers the ordered products to the delivery address.
• The cost of delivery is borne by the Buyer, unless the parties agree otherwise.
• The risk passes to the Buyer upon receipt of the products.
• The Buyer is obliged to check the products upon receipt.
• In the event of defective or damaged goods, a report must be made and the Buyer must immediately notify the Seller.
• All products come with a technical data sheet and a receipt.
• Warranty claims for machines are made with an invoice.
• Detailed technical data, price lists and warranty cards are sent by email upon invoicing
• The Buyer may only assert a warranty claim as a B2B buyer.
• Warranty claim: possibility of repair, replacement, price reduction or withdrawal.
• Deadline: 2 months after the discovery of the defect, but no more than 1 year from the date of delivery.
• The warranty period for the machines is the period specified by the manufacturer, but a maximum of 12 months from the date of delivery.
• In the event of a warranty claim, the Seller is obliged to repair or replace the machine as soon as possible, but no later than 30 days.
• If repair or replacement is not possible, the Seller is obliged to refund the purchase price to the Buyer based on the invoice.
• Warranty claims can only be asserted in the case of machines, upon presentation of the invoice or warranty card.
• The warranty does not apply to powder paints, liquid paints, parts, masking materials and training.
• The contract may be amended in writing, by mutual agreement of the parties.
• In the event of termination of the contract, the price for the services and deliveries performed up to the date of completion shall be paid.
• The Seller processes the Buyer's data in accordance with Romanian data protection laws, exclusively for the performance of the contract.
• The data is transferred to third parties only for the purpose of delivery or the fulfillment of a legal obligation.
• Seller reserves the copyright to all content (website, catalog, educational materials).
• Buyer may use, copy or distribute the materials for business use only without the written permission of Seller.
• The parties are obliged to keep business secrets, orders and contractual terms confidential, even for 5 years after the termination of the contract.
• The Seller is not liable for the performance of the contract if it is the result of a Vis maior.
• Vis maior: natural disaster, war, strike, epidemic, disruption of the supply chain.
• The parties are obliged to notify each other immediately and modify the performance proportionately.
• In case of disputes, they will first try to resolve them through negotiations.
• If this fails, the dispute must be brought before the Romanian courts.
• Governing law: Romanian law.
• The Buyer is obliged to pay the price of the products based on the invoice issued by the Seller.
• Payment deadline: advance payment or cash on delivery, unless the parties have agreed otherwise in writing.
• In case of late payment, the Seller may charge late payment interest in accordance with the Romanian legislation in force.
• The Seller is not liable for damages resulting from improper use, improper operation or external interference.
• The Buyer may only use the product for its intended purpose.
• The invalidity of individual points of the GTC and the contract does not affect the validity of the other points.
• The Buyer acknowledges that the GTC applies to contracts between companies and is not considered a consumer contract.
• These GTC are valid from 2025.09.05 and are effective until revoked or amended.
• The GTC becomes part of the contract upon acceptance by the Buyer.
- According to the applicable consumer protection regulations in Romania (O.G. no. 130/2000 and G.E.O. no. 34/2014) and Hungary (Government Decree 45/2014), products available on our online ordering platform that are produced based on the Customer’s individual specifications (e.g. custom color mixing) or specially sourced from external warehouses upon request, are excluded from the 10/14-day withdrawal right and therefore cannot be returned or exchanged.
